D.A. not seeking death penalty against Niketa Floyd

KFDM News has learned a district attorney will not seek the death penalty in the case of a 22-year-old woman charged with capital murder.

Niketa Floyd is scheduled to stand trial February 17 in Hardin County for the shooting death of a man three years ago.

The body of Alex James Joseph III was found in February of 2007 beneath the Village Creek Bridge near Lumberton.

There were two shotgun wounds to the chest of the 21- year-old victim from Orange.

Floyd's husband, Randy, pleaded guilty to murder and is serving a 45 year old sentence.

District Attorney David Sheffield tells KFDM News he isn't seeking the death penalty against Niketa Floyd because the special circumstances needed to seek the death penalty, such as proving she would be a continuing threat to society, aren't present.

If convicted of capital murder she would receive an automatic life sentence without the possibility of parole.
