Capital murder case to go to jury Thursday

ORANGE - The prosecution and defense have rested in the capital murder trial of a man charged with killing and dismembering a woman, and the jury has recessed until Thursday when closing arguments are scheduled.

Prosecutors presented testimony Wednesday linking James Edward Holden, 42, to the Bridge City mobile home where they say he killed Theresa Foskey before dismembering her and dumping her body parts in the Sabine River between Newton and Deweyville in September, 1995.

The testimony came in the third day of Holden's capital murder trial in Orange. Holden, of Deweyville, is charged with capital murder in the killing of Foskey, 28, of Bridge City.

Prosecutors aren't seeking the death penalty. If convicted, Holden would face a life sentence. 

Wednesday morning a witness from the Texas Department of Public Safety testified that DNA from semen found at the crime scene matches Holden.

Wednesday afternoon prosecutors presented evidence that a footprint found at the scene of the body could have come from Holden.

The defense put on witnesses who contend Holden didn't kill Foskey and can't be linked to her murder.

Tuesday a doctor who conducted the autopsy on Foskey testified that she died from two stab wounds to the chest, which punctured her left lung.

He also testified that Foskey suffered six blows to the head from an object with a sharp edge, consistent with a steam iron investigators contend might have caused the injuries.
