Hardin County DA: Charge dropped against sexual assault suspect because sergeant who worked on the case is under federal investigation
KFDM News - The Hardin County District Attorney says he was forced to drop a sexual assault charge against a suspect on trial because a sergeant who worked on the case is under federal investigation.
Testimony was set to begin Wednesday in the trial of Toby Langham. Officials charged with sexual assault in a 2009 case involving a teenage girl.
Claudia McDaniel accepted a plea in the same case and is serving time in prison. She was scheduled to testify against Langham.
District Attorney David Sheffield said he learned Wednesday that Sergeant Jerry Roberts was under investigation by the U.S. Attorney's Office.
Roberts helped gather evidence in the Hardin County case. Sheffield says when he learned of the probe into Roberts, he was forced to drop the charge against Langham.
Sheffield is now deciding how to handle other charges against Langham, stemming from the 2009 case.
A spokesman for the Hardin County sheriff's office confirmed that the office placed sergeant Roberts on paid administrative leave on March 6th due to a federal investigation.
