Judge Adams denies Jessie Haynes request for new trial

JEFFERSON COUNTY - BISD Special Assistant to the Superintendent for Communications Jessie Haynes filed for and was denied a motion for new trial on her Class B Misdemeanor conviction for obstructing a public passageway.


 


She filed the motion June 17 and County Court at Law #3 Judge Langston Adams denied the motion the same day.

Haynes filed an appeal with the Ninth Court of Appeals following her conviction May. That appeal could take weeks or months to resolve.


 


Attorney David Barlow is representing Haynes on appeal.


 


"I anticipated this would happen, that the motion for new trial would be denied," Barlow told KFDM News. "That's why we're going to the Court of Appeals-to review the legal aspects of her case. There was a witness that was not called at trial that would have proven the area she was standing in was not a public passageway. That is Dr. Timothy Chargois, the BISD Superintendent. Perhaps if he'd testified the outcome would have been different. Dr. Chargois determines what areas of the administration building are public or private."


 


A jury convicted the BISD director of communications May 22 for blocking a public passageway August 1 inside the administration building.

Judge Adams sentenced Haynes to two years probation, a $2,000 fine and ordered her to undergo an anger management class, a behavior modification program and an impulse control education program.

Judge Adams ordered Haynes to do 100 hours of community service. We've obtained a copy of the judge's sentencing document. We've discovered the judge has ordered that the community service hours should target rebuilding and repairing relations with the community and BISD.

Haynes has to perform at least five hours of community service every week.
