New twist in Kountze religious banners case
KOUNTZE - There's a new twist in the legal battle between the Kountze ISD and cheerleaders who want to display religious banners at school-sponsored sporting events.
Earlier this year, a state district judge ruled in favor of the cheerleaders. He said they had a Constitutional right to place religious messages on run-through banners at football games and other school-sponsored events. The school district appealed.
Last week, the American Civil Liberties Union filed court papers supporting the district. The ACLU argues the banners violate the Constitution because they're a form of government speech sponsored by the school and amount to government establishing a religion.
According to David Starnes, an attorney for the cheerleaders, Kountze ISD wants a court to throw out the ACLU brief, even though the ACLU supports the school district.
