DA to review case involving death of 94-year-old passenger
TYLER COUNTY - The Tyler County District Attorney's Office will review the investigation into a crash that killed a 94-year-old passenger in a collision near Fred.
The Texas Department of Public Safety says it's completed the crash investigation into a May 3 collision that resulted in the death of 94-year-old Heubert Browning of Silsbee. Due to the circumstances surrounding the crash, DPS has submitted the crash report to the Tyler County District Attorney's office for review. After the review, the case will be presented to a grand jury to determine if an indictment will be handed up based on the evidence and circumstances of the particular case.
Prior information from DPS: At approximately 2:30 pm on May 3, 2014, there was a two vehicle crash on FM 92 near Fred, Texas in Tyler County. A 2001 Buick passenger vehicle was southbound on FM 92 in front of a 1999 Acura passenger vehicle. The driver of the Acura failed to control speed and struck the Buick from behind. The driver of the Buick, 84 year old Lydia Browning of Silsbee, was transported to Tyler County hospital in Woodville with minor injuries. One of the passengers in the Buick, 55 year old Jeffery McGallion of Silsbee, was also transported to Tyler County hospital in Woodville with minor injuries. The second passenger in the Buick, 94 year old Heubert Browning of Silsbee, was transported to St. Elizabeth hospital in Beaumont with critical injuries. Browning died from injuries sustained in the crash on May 4, 2014 at 10:20 pm. The driver of the Acura, 17 year old Michele Whitmire of Spurger, received minor injuries and was not transported to the hospital. This is an ongoing investigation and charges are pending.
