Man indicted for murder in baby's death

JASPER COUNTY - The Jasper County grand jury has indicted a man on a charge of murder for the 2013 death of his girlfriend's baby.

This story comes to us through KFDM's media partnership with KJAS/Rayburn Broadcasting in Jasper.

The grand jury indicted Justin DeWayne Havard, 23, in the death of Rylan McDaniel. Investigators say McDaniel died while Havard was supposed to be watching the toddler while the mother, Samantha Lynn McDaniel, was at work.

Jasper Police Chief Robert MacDonald said at about noon on Friday, November 8, Havard called 911 and told dispatchers a baby was choking in Myrtis Village Apartments, 200 Myrtis Street. MacDonald said Havard, who is the boyfriend of the child's mother and not the biological father, was supposed to be watching the baby, along with the baby's 4-year-old sister.

According to MacDonald, the child was first taken by ambulance to Christus Jasper Memorial Hospital, where Detectives Derek Woods and Garrett Foster interviewed Havard and others.

The baby was later taken to Texas Children's Hospital in Houston where he died the following day.

MacDonald said an autopsy revealed that the baby died as the result of "blunt force trauma to the head".

Havard was arrested a few days later and was initially charged with injury to a child, with bond denied.
