BEAUMONT - The Beaumont school district and the Texas Education Agency now have 'one extra day to prepare for a court battle.
At stake: The takeover of the district.
Education Commissioner Michael Williams says mismanagement of finances and a loss of public trust merit the replacement of school trustees with a board of managers and removal of the superintendent Dr. Timothy Chargois.
Williams intended to make that happen by June 15th.
But a judge issued a temporary restraining order last month blocking the takeover.
A hearing on a temporary injunction was set for Monday morning in Austin, but it's been moved to Tuesday morning at 9 p.m.
Texas Education Agency spokeswoman DeEtta Culbertson tells KFDM News the hearing was delayed at the request of Travis County. She says a crowded court docket with a number of CPS cases may be to blame. Those have a higher priority.
And there is no decision yet following another hearing the record review hearing last Friday in Austin.
Attorneys for BISD argued against the lowering of the district's accreditation and against moving the special education monitor Fred Shafer to conservator.
The attorneys say the district should be allowed more time to make improvements.
The Texas Education Agency says BISD has had more than enough time and the state needs to step in for the sake of the children the district and the community.
