The Commissioner of Education, Michael Williams, has ordered the replacement of the seven BISD trustees with a Board of Managers and the replacement of the superintendent, Dr. Timothy Chargois. Williams cites extensive TEA investigative reports that show the district has severe financial and organizational problems, and has lost the public trust.
TEA guidelines call for an automatic Record Review of the Commissioner's decision. The district lost the first record review in June when a high-ranking TEA administrator ruled against the district's challenge of the Commissioner's decision to reduce its accreditation and elevate the Special Education Monitor, Fred Shafer, to Conservator.
During Thursday's Record Review, attorneys for BISD will challenge the Commissioner's decision to replace trustees with a Board of Managers and to replace the superintendent, Dr. Timothy Chargois.
Williams has said if the TEA administrator who oversees the hearing upholds his decision, he expects to quickly name a board of managers.
The district briefly blocked the takeover when an Austin judge issued a Temporary Restraining Order. Last month, another judge refused to grant the district a Temporary Injunction to block the takeover. The district had planned to consider an appeal of that order but the Education Commissioner has said BISD can't spend more than $10,000 without his approval because of severe financial problems. The Jefferson County District Attorney, Cory Crenshaw, has also warned the district about voting without proper authority.
